1 · Who we are

Gift & Meet is operated by Gift&Meet LLC, a limited liability company organised in the State of Colorado, United States, entity ID 20268135579, with an address for notices at c/o Northwest Registered Agent LLC, 1500 N Grant St, Ste N, Denver, CO 80203, United States. The full company details are in the Legal Notice.

By creating an account you accept these terms. If you do not accept them, do not create one.

2 · Who can join

3 · What Gift & Meet is

Gift & Meet is a private community with admission. One side — a Gifter — can send another person a counted box of roses together with a written note. The other side — a Muse — decides, one at a time, whether to accept. Accepting opens a conversation inside the application.

We do two things: we run the application, and we arrange for a partner florist to deliver real flowers. We do not read what members write to each other, we are not a party to it, and we do not arrange, supervise or guarantee anything that happens between them away from the application.

We are not a payment service. Money moves from the Gifter's payment method to the partner florist, who is the seller of the roses, and we keep a commission out of it. It never moves to a Muse, and a Muse cannot be paid, tipped or reimbursed through Gift & Meet in any way.

4 · How a gesture works

Step by step, because every step has a consequence:

  1. The Gifter chooses a tier of roses and writes a note. The note is required.
  2. He confirms, and the gesture reaches the Muse straight away. Nobody reads it first.
  3. She has 24 hours to decide, counted from the moment he sent it.
  4. If she declines, or the 24 hours pass without an answer, the gesture is cancelled and the full amount returns to the Gifter's payment method. The gesture stays in both of your own histories, marked as declined, and nowhere else: it scores nothing, it counts against nobody, and it is not shown to anyone else.
  5. If she accepts, she writes a greeting in the same action, a conversation opens between the two, and a redemption code is issued to her.

Nobody can ask for a gesture, and no message can reach a Muse before she accepts one.

A decline is a no to that gesture, not a permanent bar. You may send to the same person again, at any tier — nothing in the application suggests that you send a larger one, and a larger one buys nothing. What changes on a second attempt is the note. If a Muse does not want to receive anything else from you, she blocks you, and that is one tap on your profile.

5 · What a gesture does not give you

Read this one

Sending a gesture does not buy a reply, a conversation, access to a person, a meeting, or any behaviour at all from the person who receives it. What it buys is a box of roses that reaches her only if she chooses to accept it, and the possibility — not the promise — that a conversation opens.

A Muse is free to decline any gesture, for any reason or none, and declining costs her nothing. She is free to end a conversation at any time. Nothing in this agreement obliges any member to meet anyone, anywhere, ever.

A Muse never receives money, in any form: no cash, no credit, no balance, no payout, no transfer. What she receives is flowers.

Attempting to use a gesture as leverage — suggesting that it entitles you to something, or that it should be repaid in any way — is a breach of these terms and is grounds for removal under section 12.

6 · Prices, payment and refunds

Gestures are described by the number of roses. In Dubai, the tiers are:

GesturePrice
50 rosesAED 999
100 rosesAED 1,999
300 rosesAED 3,999
1,000 rosesAED 9,999

Prices are set per city and can change. The price you see on the confirmation screen, before you commit, is the price that applies to that gesture.

Prices include VAT. In Dubai that is 5%, and the price you see is the price you pay: there is nothing added at the end. The seller of the roses is the partner florist, a business licensed in her city, and it is the florist who accounts for that VAT. Gift&Meet LLC runs the application, arranges the delivery and charges the florist a commission; we are not the seller of the flowers. A refund returns the full amount you paid, VAT included.

Payment is processed by Stripe. We do not see or store your card number.

When money comes back

How quickly the money appears on your statement is up to your bank, not us. It is normally a few working days.

When it does not

Once a Muse accepts, the roses are hers and the gesture is complete on our side. From that point the amount is not refundable, except where section 15 or the mandatory law of your country of residence says otherwise.

7 · The roses, the code and the florist

The roses are real. When a Muse accepts, she receives a code to redeem at a partner florist in her city.

If the 30 days pass

If no delivery is requested within 30 days of acceptance, the code expires, the flowers are no longer available, and the amount is not refunded to the Gifter. The application shows the remaining time during the last ten days of that window, and states plainly that an expired code is no longer valid.

Partner florists are independent businesses, not our agents or employees. We choose them, we contract with them and we are answerable to you for arranging the delivery, but they run their own shops.

8 · If the flowers do not arrive

A Muse whose flowers have not arrived can say so from the application during the seven days after the florist marks the code as delivered. That opens a dispute, and a person at Gift & Meet decides it. Nothing about it is automatic.

There are two outcomes. Either the delivery is confirmed and the florist is paid, or it is not — in which case the florist is not paid, the code becomes valid again and the florist still owes the delivery. Not paying a florist is not a penalty: it means the delivery did not happen.

9 · Your content

Your photographs, your videos, your profile text, your notes and your messages remain yours. You give us a non-exclusive, worldwide, royalty-free licence to store them and to show them inside Gift & Meet, for as long as your account exists and only for the purpose of running the service. We do not sell them, we do not license them to anyone else and we do not use them in advertising without asking you first.

You confirm that what you upload is yours to upload, that the people in your photographs are you, and that you have the right to give us that licence.

If a Muse chooses to post about her flowers on her own social accounts, what she posts is entirely hers. We write nothing for her and we generate no image for her.

10 · How you must behave

Do not:

Accepting a gesture and then disappearing is not a criminal matter, but it is the one thing a Gifter can report, and repeated reports have consequences under section 12.

11 · We do not read what you write

Nobody at Gift & Meet reads a note before it reaches her. Notes are not screened, and neither are conversations. What you write goes to the person you wrote it to, and to nobody else.

What keeps this safe to receive is not a reader, it is what it costs to send: both sides are identity-verified against a document, and every note carries a box of roses behind it. Nobody can send a hundred messages, and nobody can send one anonymously.

After that, a Muse has the same tools she has in a conversation: she can decline at no cost, she can block, and she can report. A report is read by a person, who can see the note and the thread.

12 · Reports, and what follows

A report can be made from inside a conversation, by either side, choosing from a closed list of reasons and describing what happened. One report per conversation.

Who made a report is never revealed to the person reported. It is visible to our team and nowhere else.

Reports are reviewed by a person. Reports do not by themselves change anyone's position in the application. What they can lead to is a ladder, applied at our discretion and in proportion to what happened:

For serious matters — someone who is not the person in the photographs, harassment or abuse, or an economic proposal — we can suspend or close an account immediately, without going up the ladder. If we close your account for a breach, gestures pending on it are cancelled and refunded, and money already spent is not returned to you.

13 · Featured

Featured is a period of extra visibility that we grant at our discretion, for a limited time, to a Muse who has posted about her flowers and tagged us and has sent us proof of it. Proof does not entitle anyone to anything: a person checks it against the tag that actually reaches us, and decides.

Featured cannot be bought, carries no position or ranking, and can be removed at any time. Nothing is paid for posting, and nothing is owed to anyone for posting.

14 · Ending your account

You can delete your account from inside the application, at any time, without writing to anyone. When you do:

We can suspend or close an account for a breach of section 10, for a failed or withdrawn identity verification, or if we are required to. Where it is reasonable to do so, we will tell you why.

Some records survive deletion because we are required to keep them: transaction records for tax and accounting, and records relating to a report or a legal claim. The periods are in the Privacy Policy.

15 · Right of withdrawal

Gift & Meet operates in Dubai, so this section will not apply to most people. It applies if you are a consumer resident in the European Union or the United Kingdom, and it is here so that it already exists the day it is needed.

You normally have 14 days to withdraw from a distance contract. A gesture is not compatible with that period, because it is performed within 24 hours: the note is delivered straight away, and it is either accepted or refunded immediately.

What you agree to when you send a gesture

By confirming a gesture you expressly request that we begin performing immediately, and you acknowledge that you will lose your right of withdrawal once the gesture has been accepted by the Muse and the roses have been issued to her.

Until that moment you lose nothing: if she declines, or does not answer within 24 hours, the full amount returns to you automatically without you having to withdraw from anything.

16 · What we are responsible for

We are responsible for running the application with reasonable care, for arranging the delivery of the flowers you paid for, and for acting on reports.

We are not responsible for what another member says or does, for whether anyone replies to you, for what happens between two people who choose to meet, or for a partner florist's own conduct beyond arranging and paying for the delivery. Except where the law does not allow us to limit it, our total liability to you for anything connected with these terms is limited to the amounts you paid us in the twelve months before the event.

Nothing here excludes liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be excluded by law. If you are a consumer, none of this removes the rights that the mandatory law of your country of residence gives you.

The application is provided as it is. We do not promise it will be uninterrupted, and we can change or withdraw features — but not the terms on which a gesture you have already sent will be handled.

17 · App stores

If you installed Gift & Meet from the Apple App Store, this agreement is between you and us and not with Apple. Apple is not responsible for the application or its content and has no obligation to support it. Apple and its subsidiaries are third-party beneficiaries of this agreement and may enforce it against you. If the application does not conform, you may notify Apple and Apple may refund the purchase price, if any; beyond that Apple has no other warranty obligation. The equivalent applies to Google for installations from Google Play.

18 · Changes to these terms

We can change these terms. If a change matters to you, we will tell you inside the application before it takes effect, and the date at the top will change. If you do not accept a change, you can delete your account. A gesture already sent is always handled under the terms in force when it was sent.

19 · Law, disputes and contact

These terms are governed by the laws of the State of Colorado, United States, and the courts of Denver, Colorado have jurisdiction.

If you are a consumer, that does not take anything away from you. You keep the protection of the mandatory rules of your country of residence, and you can bring a claim before the courts there.

Before any of that, write to us: legal@giftandmeet.com, or use the support thread inside the application, which is faster and reaches the same people.
